The Democracy Now! Contract

At the June 2002, interim Pacifica National Board (iPNB) meeting Board Chair Leslie Cagan presented what she represented as a signed contract between the Pacifica Foundation and the new owners of Democracy Now!. This has sparked considerable controversy as to whether or not the iPNB Chair and the Executive Director were empowered to sign such a contract, why the Directors of the iPNB were not given time to read the contract before voting on it, why the Directors of the iPNB voted on it at all, the legality of the contract in light of the settlement agreement, the legality of the contract in light of the Pacifica Foundation's articles of incorporation and sundry lesser issues.

June 23, 2002. This contract, dated June 13, 2002, is presented to the iPNB.

July 5, 2002. The Secretary of the iPNB issues an apology for letting this slip through as it did.

July 6, 2002. The Secretary of the iPNB requests a special meeting to discuss renegotiation of the Democracy Now! contract, and makes several legal arguments regarding it including an analysis of the contract by Peter Franck, past Chair of the PNB and intellectual property lawyer.

July 9, 2002. The host and senior producer of Democracy Now! issue a statement about the contract.

July 9, 2002. Secretary of the iPNB responds to statement by host and senior producer of Democracy Now!.

July 15, 2002. Chair of iPNB announces that a meeting will be held on the Democracy Now! contract controversy on July 16. This meeting will be held in executive session.

July 16, 2002. Statement from iPNB regarding its meeting about the Democracy Now! contract.

July 23, 2002. Statement from the iPNB regarding its July 22, meeting to continue dealing with the Democracy Now! contract. They're forming a committee. We will keep this page updated.
